OVERVIEW

Welcome to Outlet Vidros & Candeeiros (“we”, “our”, “us”). We operate this website and the associated services, including the information, features, tools, products and content made available to you (the “Services”). Our online shop is operated through the Shopify platform.

These Terms of Service (“Terms”) govern access to and use of the Services and set out the rights and obligations between you and Outlet Vidros & Candeeiros.

By accessing the website, using the Services or making a purchase, you declare that you have read, understood and accept these Terms, as well as our Privacy Policy. If you do not agree, you should not use the Services.

SECTION 1 — ACCESS AND ACCOUNT

By accepting these Terms, you declare that you are of legal age in your country of residence.

To use certain Services, you may be asked to provide personal information such as your name, address, e-mail and payment details. You undertake to provide true, complete and up-to-date information.

You are solely responsible for:

  • keeping your access credentials confidential;
  • all activity carried out through your account.

Transferring, assigning or licensing the account to third parties is not permitted.

SECTION 2 — OUR PRODUCTS

We aim to represent our products as faithfully as possible. However:

  • colours, textures, finishes and tones may vary depending on the device used;
  • we do not guarantee that the products will fully match your subjective expectations.

Some of the products we sell are classified as Outlet, used or vintage. These items may show signs of use, natural variations in the material or small imperfections, which are duly described in the relevant product listing and are not considered defects.

We reserve the right to change descriptions, suspend or discontinue products, and limit available quantities, at any time.

SECTION 3 — ORDERS

By submitting an order, you make an offer to purchase.

We reserve the right to accept, refuse, modify or cancel orders, in whole or in part. An order is only considered accepted after express confirmation and payment processing.

Before completing your order, you should carefully check all the details. After acceptance, changing or cancelling the order may not be possible.

Returns, exchanges and cancellations are governed by the Returns and Refunds Policy.

Unless otherwise agreed in advance, the products are intended for personal or domestic use.

SECTION 4 — PRICES AND BILLING

Prices, campaigns and promotions may change without prior notice. The applicable price will be the one shown at the time of purchase and confirmed in the order confirmation e-mail.

Outlet Vidros & Candeeiros operates under the VAT exemption regime, pursuant to Article 56 of the Portuguese VAT Code (ENI – sole trader).
The prices shown do not include VAT, and VAT is neither charged nor refunded under any circumstances.

Unless otherwise stated, prices do not include:

  • shipping costs;
  • customs duties, local taxes or import charges, where applicable.

You undertake to provide correct and up-to-date payment details, and declare that you are authorised to use the payment method provided.

SECTION 5 — SHIPPING AND DELIVERY

Delivery times are merely indicative and may vary depending on the destination, carrier or external factors. We do not guarantee specific delivery dates.

Outlet Vidros & Candeeiros is not responsible for delays caused by carriers, customs services, strikes, weather conditions or other events beyond its control.

The risk of loss or damage to the products transfers to the customer at the moment they, or a third party designated by them, take physical possession of the goods, under the applicable law.

SECTION 6 — INTELLECTUAL PROPERTY

All content made available in the Services — including texts, images, graphics, logos, trademarks, videos, design and layout — is the property of Outlet Vidros & Candeeiros or its respective owners, and is protected by applicable legislation.

The Services are intended exclusively for personal, non-commercial use. Unauthorised reproduction, modification, distribution or use of any content without prior written authorisation is prohibited.

SECTION 7 — OPTIONAL TOOLS

The Services may include third-party tools, provided “as is” and “as available”, without warranties. Use of these tools is entirely at your own responsibility.

SECTION 8 — THIRD-PARTY LINKS

The Services may contain links to third-party websites. Outlet Vidros & Candeeiros is not responsible for the content, products, services or transactions carried out on those websites.

You should review the policies and terms of those third parties before any interaction.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Outlet Vidros & Candeeiros uses Shopify technology to host and operate the online shop. Transactions are carried out exclusively between you and Outlet Vidros & Candeeiros, with Shopify not being a party to the contract.

You release Shopify from any liability relating to purchases or use of the Services.

SECTION 10 — PRIVACY POLICY

The personal data collected is subject to our Privacy Policy. Some processing may also be subject to Shopify's Privacy Policy.

SECTION 11 — FEEDBACK

By sending comments, reviews or suggestions, you grant Outlet Vidros & Candeeiros a free, worldwide, irrevocable and perpetual licence to use, modify and publish that content.

You warrant that you hold the necessary rights to the content you send.

SECTION 12 — ERRORS, INACCURACIES AND OMISSIONS

There may be typographical errors or inaccuracies regarding prices, descriptions, availability, promotions or deadlines. We reserve the right to correct such information and to cancel orders where necessary.

SECTION 13 — PROHIBITED USES

It is prohibited to use the Services for unlawful purposes, to infringe third-party rights, to send malicious content, to collect data without consent or to circumvent security measures.

We reserve the right to suspend or close accounts that violate these Terms.

SECTION 14 — TERMINATION

We may suspend or terminate access to the Services at any time if these Terms are violated. You remain responsible for any amounts owed up to the date of termination.

SECTION 15 — DISCLAIMER OF WARRANTIES

The Services and products are provided “as is” and “as available”. We do not guarantee that access will be uninterrupted or that the products will meet specific expectations.

SECTION 16 — LIMITATION OF LIABILITY

To the maximum extent permitted by law, Outlet Vidros & Candeeiros will not be liable for indirect damages, loss of data, loss of profits or losses resulting from the use of, or inability to use, the Services.

SECTION 17 — INDEMNIFICATION

You undertake to indemnify Outlet Vidros & Candeeiros against any claims arising from a breach of these Terms, misuse of the Services or infringement of third-party rights.

SECTION 18 — SEVERABILITY

If any provision of these Terms is deemed invalid, the remaining provisions will remain fully in force.

SECTION 19 — WAIVER AND ENTIRE AGREEMENT

Failure to enforce any right does not constitute a waiver of it. These Terms constitute the entire agreement between the parties.

SECTION 20 — ASSIGNMENT

You may not assign your rights or obligations without written consent. Outlet Vidros & Candeeiros may transfer its rights without prior notice.

SECTION 21 — GOVERNING LAW

These Terms are governed by Portuguese law. Any dispute will be submitted to the courts of the area where Outlet Vidros & Candeeiros has its registered office.

SECTION 22 — CHANGES TO THE TERMS

We reserve the right to change these Terms at any time. Continued use of the Services after changes constitutes acceptance of them.
